USER AGREEMENT

Welcome to the Web site for the Dreyfus Health Foundation (DHF), a division of The Rogosin Institute (together, “DHF”). This agreement governs your use of the DHF Web site (“User Agreement”). It includes DHF’s privacy policy (“Privacy Policy”). Please read the User Agreement and Privacy Policy carefully, because by visiting or using the DHF Web site, you agree to follow the rules contained in them. From time to time, we may modify these rules, so please review this Web page periodically for changes. Your continued use of the DHF Web site after any modifications indicates your agreement to the modified terms.

Trademarks
The DHF Logo, PROBLEM SOLVING FOR BETTER HEALTH^®, PSBH^®, COMMUNICATIONS FOR BETTER HEALTH^®, CBH^®,NO EXCUSES^®, and other trademarks, logos, and indicia of source displayed on the DHF Web site (collectively “Trademarks”) are owned by DHF. The Trademarks may not be used in connection with any product or service that does not belong to DHF or in any manner that is likely to cause confusion about whether DHF is the source, sponsor, or endorser of the product or service without our prior written consent, and may not be used in any manner that disparages or discredits DHF or The Rogosin Institute.

Links to the DHF Web Site, Frames, and Metatags
You may not link to the home page of the DHF Web site in any way that might cast DHF in a false or misleading light. You may not frame the DHF Web site content so that it is viewed on another site. You may not use metatags or any other “hidden text” that incorporates the name DHF or the Trademarks without our express written consent.

Links to Other Web Sites
The DHF Web site contains links to other Web sites that contain information we think would interest you. We have no control over these sites or their content. You should be aware when you leave the DHF Web site for another site, and make sure that you read that site’s terms of use and privacy policy before using the site.

Disclaimers and Limitation of Liability
ALTHOUGH WE INTEND TO TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES, WORMS, “TROJAN HORSES,” OR OTHER DESTRUCTIVE MATERIALS TO THE DHF WEB SITE, WE DO NOT GUARANTEE OR WARRANT THAT THE DHF WEB SITE OR MATERIALS THAT MAY BE DOWNLOADED FROM THE DHF WEB SITE ARE FREE FROM SUCH DESTRUCTIVE FEATURES. WE ARE NOT LIABLE FOR ANY DAMAGES OR HARM ATTRIBUTABLE TO SUCH FEATURES.

WE ARE NOT LIABLE FOR ANY CLAIM, LOSS, OR INJURY BASED ON ERRORS, OMISSIONS, INTERRUPTIONS, OR OTHER INACCURACIES IN THE DHF WEB SITE, NOR FOR ANY CLAIM, LOSS, OR INJURY THAT RESULTS FROM YOUR USE OF THE DHF WEB SITE OR YOUR BREACH OF ANY PROVISION OF THIS USER AGREEMENT.

Termination
DHF reserves the right to terminate this User Agreement at any time without notice for any reason, including for a user’s violation of any of the User Agreement provisions. The Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.

Agreement is Governed by the Laws of New York
This User Agreement and any claim or dispute relating to it will be governed by the laws of the State of New York applicable to contracts made and performed there without regard to its conflicts of law principles.

Severability
If any provision of this Agreement is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severed and will not affect the validity and enforceability of any remaining provision.
